ALL APPROPRIATE INQUIRY STANDARD The US EPA has posted the Preamble to the new ALL APPROPRIATE INQUIRY standard for environmental assessments (click here to see it). Based on information available from a number of sources and a quick review, it is clear that the environmental due diligence process is about to change. Specifically, for the first time, there will be a standard for environmental professionals performing Phase I ESAs. In addition the EPA rule will require a more extensive records search and more effort to fill data gaps. While the driver for this regulation is Federal Brownfields regulations, it is expected that most Phase I ESAs will be performed to the new standard, or at least will incorporate certain portions of the new standard.
